Chapter 2. Technical Requirements

To use the Store, the following are required:

  • a computer or other device with an internet browser;

  • access to the Internet;

  • an active e-mail address.

Chapter 3. Personal Data

The controller of customers’ personal data is the Seller.
All information regarding the processing of personal data of customers and other users of the Store’s website can be found in the Privacy Policy.

Chapter 4. Conclusion of the Sales Agreement, Customer Account

The Store enables the purchase of goods (hereinafter referred to as the “Goods”) displayed on the Store’s website in two modes:

  • without registration;

  • with the creation of a Store account.

In both cases, in order to place an order, the customer must select the Goods, add them to the “Cart” using the appropriate button, and then continue the ordering process by selecting the relevant options (delivery and payment method).

Product information in the Store, including descriptions and prices, constitutes an invitation to conclude a sales agreement within the meaning of Article 71 of the Polish Civil Code, in accordance with these Terms.

Placing an order requires completing all mandatory fields in the order form necessary to perform the agreement and, optionally (at the customer’s request), the data required to issue a VAT invoice.

If the customer decides to create an account in the Store (hereinafter referred to as the “Account”), registration is a one-time process. The e-mail address and password chosen by the customer constitute the basis for future logins. Details regarding the Seller’s provision of the digital Account service are set out below in the Account Terms. The Store also allows login via social media and/or a Google user account. After logging in, the customer has access to their order history and does not need to re-enter personal data for subsequent orders.

The customer may cancel the Account at any time without incurring any costs by sending a request to: info@silray.pl.

Approval of the order by clicking the “Buy and Pay” button (or a button with equivalent wording) constitutes:

  • submission of an offer to purchase the Goods under the selected options and these Terms;

  • acceptance of the obligation to pay the price of the Goods and delivery costs.

A sales agreement (hereinafter referred to as the “Agreement”) is concluded when the Seller accepts the order for processing, which is confirmed by an e-mail message.

If it is not possible to fulfill the order in whole or in part, the Seller will inform the customer, and the Agreement will not be concluded. The Seller will also inform the customer of available alternatives, such as partial fulfillment or waiting for restocking. If payment has already been made, the Seller will promptly refund the amounts paid, in proportion to the canceled part of the order.

The Seller provides confirmation of the concluded Agreement on a durable medium no later than upon delivery of the Goods.

The Store is not liable for non-delivery or delays caused by incorrect or incomplete delivery details provided by the customer.

The Seller reserves the right to suspend order processing if the customer provides false data or if the data raises justified doubts as to its accuracy. In such cases, the Seller will attempt to contact the customer to verify the information.

Chapter 5. Prices and Payment Methods

Prices of Goods are given in Polish zloty (PLN) and are gross prices, including VAT.

Delivery costs are shown separately in the Store’s cart, depending on the delivery method selected.

Available payment methods are described in the “Payment Methods” section of the Store and displayed during checkout.

The Store offers the following payment methods:

  • traditional bank transfer to the Seller’s account;

  • fast electronic transfer / BLIK / virtual wallet payments via payment platforms:

    • Shoper Payments (Autopay)

    • eCard

  • payment by card: Visa, Visa Electron, MasterCard, MasterCard Electronic;

If the customer chooses payment by traditional bank transfer, payment must be made within 7 days of placing the order. Failure to pay within this period results in the Agreement being deemed not concluded. This does not apply if deferred payment or installment payment is offered by the Seller via an external partner.

For payments via Shoper Payments, the payment service provider is Autopay S.A.

For payments via Stripe, payment services are provided jointly by Stripe Payments Europe Limited and Stripe Technology Europe Limited, based in Ireland. The rules for integration are set out in the “Stripe Integration Service Terms in the Shoper Online Store” available on the Shoper website. Consumer-facing Stripe terms are available on Stripe’s website.

Chapter 6. Delivery of Goods

Goods are delivered according to the customer’s choice:

  • via courier service;

  • to InPost parcel lockers;

  • via ORLEN Paczka.

Except for personal collection, an order is deemed fulfilled upon dispatch of the shipment. The actual delivery date is determined by the carrier.

Goods are shipped within up to 10 business days, unless a different timeframe is clearly stated in the product description. Detailed lead times are available in the “Order Fulfillment Time” section.

The Seller standardly fulfills orders within Poland at the costs indicated in the “Delivery Time and Costs” section. International shipping is available at costs specified on the Store’s website or individually agreed with the customer.

Chapter 7. Right of Withdrawal

A customer who is a consumer or a privileged entrepreneur within the meaning of Article 7aa of the Consumer Rights Act has the statutory right to withdraw from the sales agreement within 14 days of receiving the Goods, without stating a reason, subject to the exceptions listed below.

To meet the deadline, the customer must submit a withdrawal statement within the time limit:

  • electronically to: info@silray.pl, or

  • in writing to: Lindleya 16/218, 02-013 Warsaw.

A model withdrawal form may be used but is not mandatory. The Seller will promptly confirm receipt of the withdrawal by e-mail.

Within the next 14 days, the customer must return the Goods at their own expense to:
SILRAY Exu Media Sp. z o.o.,
Lindleya 16/218, 02-013 Warsaw.

The Seller will refund, no later than 14 days from receipt of the withdrawal notice:

  • the price of the Goods;

  • the cost of the original delivery using the cheapest standard delivery method offered by the Store.

The Seller may withhold the refund until the Goods are returned or proof of return is provided.

Refunds will be made using the same payment method as the original transaction unless the customer agrees otherwise.

The customer is liable for any diminished value of the Goods resulting from use beyond what is necessary to establish their nature, characteristics, and functioning.

Chapter 8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to agreements for the supply of Goods:

  • made to the consumer’s specifications or clearly personalized;

  • which are perishable or have a short shelf life;

  • delivered in sealed packaging which has been opened after delivery for health or hygiene reasons;

  • audio or visual recordings or computer software supplied in sealed packaging once opened;

  • which, by their nature, become inseparably mixed with other goods after delivery;

  • newspapers, periodicals, or magazines, except for subscription agreements;

  • whose price depends on financial market fluctuations beyond the Seller’s control;

  • alcoholic beverages whose price was agreed upon at the time of sale and whose delivery may occur only after 30 days, and whose value depends on market fluctuations beyond the Seller’s control.

Chapter 9. Complaints

The Seller is obliged to deliver Goods in conformity with the Agreement.

For consumers and privileged entrepreneurs, the Seller is liable for conformity in accordance with the Consumer Rights Act. For other customers, liability is governed by the Civil Code.

Complaints may be submitted:

  • electronically to: info@silray.pl;

  • in writing to: SILRAY Exu Media Sp. z o.o., Lindleya 16/218, 02-013 Warsaw.

Complaints will be processed within 14 days of receipt.

If dissatisfied with the handling of a complaint, consumers and privileged entrepreneurs may use out-of-court dispute resolution methods, including mediation by the Trade Inspection, assistance from consumer ombudsmen, or consumer arbitration courts. Additional information is available on the website of the Office of Competition and Consumer Protection.

Chapter 10. Product Reviews

Customers may add product reviews (“Reviews”) in the Store.
This functionality is available only to logged-in Account holders.

Reviews must comply with the Digital Services Act (DSA) and good practices. It is prohibited to post Reviews that are unlawful, offensive, pornographic, discriminatory, infringing third-party rights, or commercial/advertising in nature.

The Seller and/or an external review service provider may moderate Reviews. Non-compliant Reviews may be removed or not published. The customer will be informed of the reasons and may appeal.

Any person may submit a notice regarding allegedly illegal content by e-mail to info@silray.pl. Notices and appeals are reviewed within 14 days.

The Seller is not responsible for Reviews posted by customers provided that it has no knowledge of their illegality and promptly acts upon receiving such knowledge.

Chapter 11. Final Provisions

Polish law applies to Agreements concluded in the Store. Agreements are concluded in Polish.

Nothing in these Terms limits statutory consumer rights.

The Seller may amend the Terms at any time. Amendments apply to orders placed after publication. Existing Account holders will be notified and may reject the changes.
